Please read the following information carefully. It contains the terms and conditions governing your access and use of the VacancyDB.com website. If you do not accept these Terms and Conditions hereinafter "Terms", or you do not meet or comply with their provisions and parameters, you must not use VacancyDB.com

Definitions:

The terms "You", "User", ¡§employer¡¨, ¡§jobseekers¡¨ and ¡§member¡¨ as used herein refer to all individuals and/or entities accessing the following web sites for any reason. ¡§The company¡¨ and ¡§we¡¨ are referring to Media Peoples Limited. This Agreement is made between the Company and you, the website visitor, user, advertiser and/or registered user ("you"). ¡§The website¡¨ is referring to the following websites.

The following are definitions of terms that are used in or apply to the information contained:

  1. "VacancyDB.com website": includes www.vacancydb.com in its entirety and its related sites that are owned or operated by the Association, and includes their content, text, graphics, design, programming and services as applicable in the context.
  2. "Content": includes all text, graphics, design and programming used on the website.
  3. "Employer" means a person or entity that is accessing the Site to post a job or for any reason related to the purpose of seeking candidates for employment.
  4. "Job Seeker" means a user who is accessing the website to search for a job or in any other capacity except as an employer.
  5. "Programming": includes both client-side code (HTML, JavaScript, etc.) and server-side code (Active Server Pages, VBScript, databases, etc.) used on the website.
  6. "Services" means any services provided on the web by Media People Ltd or its agents or members, or VacancyDB.com.
  7. "Third Party" includes a person or entity not directly specified in this Agreement.
  8. "User" refers to any individual or entity who uses any aspect of the website.
  9. "You" and "you" means the person who (or the entity on behalf of whom you are acting) that is agreeing to these Terms and Conditions. )

 

This Agreement is a legal document which sets out your rights and obligations, and those of Media Peoples Limited, a company registered in Hong Kong SAR, in relation to this site and the services offered by its website and this company including the content, text, article, graphic, design, image and pictures, subject to your compliance with the Terms and Conditions stated here. You must take the time to read and understand it. Also, you must also read, understand and accept the privacy policy and disclaimer in the website before using it. By using and registering our websites, you agree to the terms of this Agreement, privacy policy and disclaimer. You should be aware that this Agreement may change from time to time in accordance with the following Clause below. You should visit the terms and conditions section in the website periodically to review the terms and conditions, because they are binding on you.

Right of Amendment


We reserve the right (a) to change the terms and conditions of this Agreement, (b) to make amendment on the web site, the privileges of users, (c) to change the web site, including eliminating or discontinuing any content on or feature of the web site, restricting the hours of availability or limiting the amount of use permitted or to change any fees or charges for use of the website, including instituting new or increased fees or charges for the use of the site or any other site-related services or any feature thereof.

Any changes we make will be effective immediately amendment without prior notice. The users should check the posting on the web site or via electronic mail. Your use of the website after such notice will be deemed acceptance of such changes. Be sure to review this Agreement periodically to ensure familiarity with the most current version.

Changes to this Agreement


We reserve the right to change this Agreement from time to time, and post the new version on the website. When we do so, the new version of these terms and conditions will govern the website:

        (a)    commencing 5 days after the date of posting (or such later date as VacancyDB.com indicates in any relevant posting), if any of the changes is to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when thenew version of the Agreement is to take effect, and from that date you must cease to use the VacancyDB.com Service; or

        (b)    immediately upon the date of posting (or such later date as VacancyDB.com indicates in the relevant posting), if the changes are not to operative provisions,or not capable of adversely affecting you - examples of which would include,without limitation, changes to one or more of VacancyDB.com¡¦s addresses or email addresses referred to in this Agreement.

Misuse of the website and its Services


We reserve the right (a) to suspend or terminate any Member¡¦s access to the website and its services, or parts of it, and/or (b) to remove, or require the Member to remove, material posted on the website, if the relevant Member or material appears to us to be in breach of any provision of this Agreement. Any person whose access has been suspended or terminated must not re-register for, or re-access, the website without our prior consent. However, there may be times when determined people whose Membership has been terminated or suspended re-register as Members, in breach of their obligations under this Agreement; we cannot prevent that. You are responsible for everything which is done on or through the website while your Membership account is logged on to the website, or through your email address(es).

We will not refund any fee to those member or user being terminated of the membership under the misuses or abuse of the website.

Termination

You agree that the Company, in its sole discretion, may terminate your registration or use of the website, delete your postings from the web site, for any reason, including, without limitation, for lack of use or if the Company believes that you have breached any of these Terms and Conditions or laws or if the Company is unable to verify or authenticate any information you submit to the website.

Assignment


We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement, but we will ensure that the assignee undertakes to perform this Agreement in accordance with its terms. You may not without the written consent of the website assign or dispose of this Agreement.

Entire Agreement


This Agreement includes our privacy policy and disclaimer. Together they are intended to contain the whole of the agreement between you and us concerning the website and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us.

 

Governing Law and Jurisdiction

The Company's Terms and Conditions and any dispute or matter arising from or incidental to your use of the web site shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR) and both you and the Company agree to submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.

 

Specific uses for jobseekers

  1. The Jobseekers agrees that:

        he or she has read, understood and agrees to the Privacy Statement on the Site;

      he or she will keep confidential and not disclose to any person the password used by them in relation to the Services;

      he or she will be responsible for any misuse of all such passwords.

  1. All information submitted by the jobseekers to the web site must be legal, and non-discriminatory. Jobseeker needs to respond for the contents and material, which they have submitted to the company or the employers, thought the website.

 

  1. The resume and personal data submitted by the jobseeker is intended for purpose of providing relevant information to users or advertisers ("employers") in seeking employees.

 

  1. Jobseeker accepts that the personal data or information given to the employers is given entirely at his / her own risk. The Company will only remind the employer to follow the law and regulation in Hong Kong. But we do not be responsible or liable in any case if any employer or any entity claimed as employer shall use the jobseekers' personal data for any other use other than for seeking employees.

 

  1. Jobseeker may send their resume directly to any employer who advertises on or through the site. Alternatively jobseeker may send their resume to the Company through the website in reply to any job advertisement. In such an event and subject to legal requirements, the jobseekers' resumes will be retained on the website for a predetermined period notwithstanding the deactivation of the service herein and, unless the jobseeker requests to erase or delete it. Thereafter it will be stored in the Company's database at the jobseeker's own risk.

 

  1. If the jobseeker would be given the option of making their resume and data searchable by the third party in the website. By joining this option, jobseeker will disclose the resume to potential employers or third party then all employers and the third party who place their advertisement with the Company or who subscribe the service of the Company will have access to the resume. This consent means the jobseeker will bare the risk of their data.       

 

  1. Under the Personal Data (Privacy) Ordinance, the jobseeker is entitled to access his/her own personal data (subject to prior confirmation of identity) kept with the Company and he/she may edit or amend such personal data at any time. Sending the request in writing to the Company can make any request for access or correction. Please refer to the Privacy policy for details. Further or alternatively, the jobseeker (subject to prior confirmation of identity) may directly edit or amend his/her personal data at any time in the site by himself/herself.

 

  1. The role of the website is only confiding to offer a platform of vacancy matching instead of any investigation or verification agency. No monitoring of the primary information provided by any user, jobseekers must search, check and investigate the information provided by any uses through the website.

 

  1.  The Company and the employers reserve the right to edit any jobseeker's resume as it sees suitable

 

  1. The website and the company will not bare any responsibility of any dispute between jobseeker and advertiser, employer or other users. The role of the website is only confiding to offer a platform of vacancy matching instead of any investigation or verification agency. We do not generally monitor and verify the quality of any user under the name of users, employer or ¡§jobseekers¡¨. The users and jobseekers have the duty of verifying and checking the data and qualify of the other users or ¡§employers¡¨ in the website.

 

Specific uses for employers

  1. Employer must responsible for the contents and materials contained in every advertisement. Every advertisement must be strictly follow the law and regulation in Hong Kong

 

  1. Employer needs to follow the Data Protection Principles under the Personal Data (Privacy) Ordinance in the collection, use, disclosure and retention of personal data. The employer reserves the right to edit any advertisement as it sees suitable. But agree that all information will only be used for the purpose of seeking potential employees and such information shall not be disclosed to any other parties without the prior consent of the jobseeker concerned.

 

  1. Upon payment of the service fee to the Company and/or upon other terms and conditions (if any) from time to time prescribed by the Company, the employer will be entitled to use the service to advertise job vacancies for a specific period.

 

  1. Subject to the conditions or requirements as from time to time stipulated by the Company regarding the access of the jobseekers' information, the employers are entitled to access the jobseekers' database maintained by the Company, if employer joins the plan of search CV function.

 

  1. The Company reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any employer should fail to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the employer's advertisement and / or accessing right to the jobseekers' database, without prejudice to all other rights and remedies.

 

  1. The website and the company will not bare any responsibility of any dispute between jobseeker and advertiser, employer or other users. The role of the website is only confiding to offer a platform of vacancy matching instead of any investigation or verification agency. We do not generally monitor and verify the quality of user under the name of users or ¡§jobseekers¡¨. The users and employers have the duty of verifying and checking the data and qualify of the other users or ¡§jobseekers¡¨ in the website.

 

The rule of job posting:

 

"Your Material(s) shall NOT contain:

                           i.                  links to any website(s) other than your own;

                         ii.                  copyrighted material (unless you own said copyright or have the owner's permission to post the copyrighted material);

                        iii.                  trade secrets (unless you own said trade secrets or have the owner's permission to post them);

                        iv.                  material that infringes on or misappropriates any other intellectual property rights, or violates the privacy or publicity rights of others;

                          v.                  anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful; or

                        vi.                  anything that is embarrassing or offensive to another person or entity;

                       vii.                  jobs that require the applicant, or employee, to make a capital investment;

                     viii.                  jobs that require the applicant, or employee, to attend unpaid training;

                       ix.                  not relevant to ¡¥real¡¦ job vacancies

Privacy Policy


The privacy policy of the website forms part of this Agreement, and by agreeing to this Agreement, you also give your consent to the way we may handle your personal data in that policy. Given the global nature of the World Wide Web, any posting on the website (including any which contain personal information) is, of course, accessible to internet users around the world. Our [Privacy Policy ¡V hyperlink], to which Members agree when registering for (or making any use of) the website, provides detailed provisions concerning our approach to privacy and data protection matters. You must take the time to read and understand the privacy policy in the website.

Prohibitions

You are responsible for ensuring that no material you post, or which is posted through a machine on which you access the website, nor any activity or communication you make in connection with the website, will be capable of

        (a) Infringing the intellectual property or other rights of any person or entity,

        (b) Breaching any applicable law, whether criminal, tortuous or otherwise, or

        (c) Appearing to be offensive, threatening, obscene, pornographic, false, unreliable or misleading.

Alerting VacancyDB.com


If you see anything on the website which appears to breach this Agreement, then please contact us to inform us of it by emailing us. We do not generally monitor material contributed by Members placed on the website, and so we are reliant upon users to point out any which is in breach this Agreement.

The website is designed for self-serve website. Therefore, the users should be not suppose there are dedicated operator to response to any request, complaints and alerting. The users shall understand the lead time may be very long to allow the website operator to take any action.

Withdrawal of material and Termination of Membership

Each Member acknowledges that we are entitled to withdraw any material on the website whether this is based on information received from Members or others, or our own determination to be capable of breaching any part of this Agreement, or to bring the website into disrepute. However, you acknowledge that we do not monitor material which appears on the website, and that we are reliant upon you and all users to notify us of anything you see here which appears likely to breach this Agreement, using the notification techniques which are made available on the website.

Disclaimer and Release


We have no control over, or responsibility for, the truth or accuracy of any material available on the website, whether provided by Members, users of employers, jobseekers or others.

  • If any third party sites are linked to, or from, the website, this does not mean that we endorse or have any responsibility for the site in question or anything which appears on it.
  • You should exercise no lesser degree of caution in appraising what you see on the website than you do offline.
  • Even though Members are prohibited from doing so, people may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Further, you should note that people may not necessarily be who they say they are.
  • Your use of the website is entirely at your own risk.
  • The website is using the 3rd Party web hosting service; the security is purely depending on their capacity. The company does not spend extra resources or extra ordinary resources on the network and website security. The users should bare their own risk on the data security while they are using the website. The company does not hold any responsibly for any data release by the 3rd party under the security fault or any hacking activities.

Accordingly, to the extent that the law permits, you release Media Peoples Limited and the website, its directors, contractors and employees, from all liability arising out of or in connection with the website and the material included here by Members and other third parties.

Intellectual Property

You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to the website (including the material which is contributed by Members and users) are owned by Media Peoples Limited. It is easy to copy material that appears on web sites, but this does not mean it is legal. Therefore, the user shall not copy, distribute, show in public or create any derivative work from the website, or any of the material which is found on the website unless properly licensed to do so by us.

By submitting any material to the content of the website, you:

  • are representing that you are fully entitled to do so;
  • grant us a non-exclusive, royalty-free, irrevocable and perpetual license to copy, modify, distribute, show in public and create derivative works from that material in any form, anywhere; and
  • authorize us to adapt the relevant material in the course of doing so, and so waive your moral rights to object to any derogatory treatment, or to be identified as the author, or have procured a waiver of moral rights from the copyright owner, as the case may be, of the material in question.

Indemnity

All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the website or their breach of the terms of this Agreement. The Company shall provide prompt notice of any such claim, suit or proceeding to the relevant user.

You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access the website.

 

Excluded loss


We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). Media Peoples Limited will also not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control.

Maximum liability


Without limiting the preceding Clause, during any period of twelve months, the aggregate liability of Media Peoples Limited under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of

        (a) the annual Full Membership fee payable at the time liability arises, or

        (b) an amount equal to the sums actually paid by you to us by way of the fees during the twelve month period prior to the date when liability arises, regardless of the cause or form of action.

        (c) In the case of the trial account or free membership, Media Peoples Limited will not    need to pay any compensation to the users (both jobseeker and the advertiser and employers.)

You expressly understand and agree that VacancyDB.com will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if VacancyDB.com has been advised of the possibility of such damages), resulting from:

        (1) The use or the inability to use the service

        (2) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service

        (3) Unauthorized access to or alteration of your transmissions or data

        (4) Statements or conduct of any third party on the service, or any other matter relating to the service)

 

Non-excluded Liabilities


Nothing in this Agreement limits Media Peoples Limited¡¦s liability for death or personal injury resulting from our negligence, or any other liability that may not by law be excluded.
